Selling an apartment with a mortgage, step by step

In brief
  • You can sell an apartment with a mortgage without repaying it first: the loan is repaid from the sale price.
  • The bank issues a certificate of the balance and consent to remove the mortgage after repayment.
  • With a variable-rate loan, the bank may charge an early repayment fee only in the first 3 years.

A mortgage on an apartment is very common and does not stand in the way of a sale. You do not need money to repay it early: the loan is repaid from the price the buyer pays.

How it works

  1. Bank certificate. You ask the bank for a certificate of the current loan balance, the account number for repayment and consent to remove the mortgage after repayment (often called a promissory letter). It is valid for a limited time, usually about 30 days, so it is ordered for a specific date of the agreement.
  2. Preliminary agreement. It states that the part of the price equal to the loan balance goes directly to your bank's account, and the rest to your account.
  3. Notarial deed and payment. The buyer (or their bank, if they buy with a mortgage) transfers the money as agreed.
  4. Repayment and consent to removal. After repayment, your bank issues the consent to remove the mortgage.
  5. Removing the mortgage from the land register. The application is filed with the land registry court, and the fee for removing a mortgage is PLN 100. This is often done by the notary or the buyer's bank.

How much you will keep

From the sale price, subtract the loan balance, any early repayment fee, the commission and other costs. You can do it in the net proceeds calculator. If the loan is higher than the realistic price, let's talk before listing the apartment. There are solutions, but they need to be planned with the bank.

Early repayment fee

With a variable-rate mortgage, the bank may charge a fee only if you repay the loan within the first 3 years of the agreement, and no more than 3% of the amount repaid. With a fixed rate, the rules are set out in the agreement and apply to the fixed-rate period. Check your agreement or ask the bank before the valuation.

What to watch out for

  • Certificate validity. Order it so that it is valid on the day of the deed.
  • Buyers with a mortgage. Their bank will want to see the certificate from your bank. The sooner you provide it, the sooner they get a decision.
  • Insurance and accounts linked to the loan. After repayment, cancel those you no longer need.
