Selling an apartment in Wrocław when you live abroad

Marlena CzarneckaUpdated: 21 October 2026
In brief
  • You can sell the apartment without travelling, through an attorney holding a power of attorney in the form of a notarial deed.
  • You can sign the power of attorney at a Polish consulate or before a foreign notary, with an apostille and a sworn translation.
  • Tax on the sale of a property in Poland is settled in Poland, under the same rules as for residents.

Moving abroad, working in another country or an apartment inherited by family living outside Poland: more and more of my clients sell their Wrocław apartment remotely. It can be done without a single trip, if the power of attorney is prepared well.

Power of attorney: the key document

Selling a property requires a power of attorney in the form of a notarial deed. Ideally a specific one, for the sale of this particular apartment, with the right to sign the preliminary agreement and the deed, receive the money and hand over the property. You can sign it:

  • at a Polish consulate in the country where you live. The consul then acts as a notary and the document is valid in Poland straight away,
  • before a foreign notary, then obtain an apostille (in Hague Convention countries) or legalisation and a sworn translation into Polish,
  • at a notary in Poland, if you are in the country before leaving. This is the simplest route.

Before signing, it is worth showing the draft power of attorney to the notary in Poland who will handle the sale deed. You will avoid a document from abroad with too narrow a scope.

Who can be the attorney

Usually a trusted family member or a lawyer. As your agent I run the whole sale: documents, preparation, viewings and negotiations, and the attorney only appears for the preliminary agreement and the deed. You can also fly in just for the deed and leave the rest to me.

Selling remotely in practice

  • Keys and access. I take the keys and organise cleaning, minor repairs and home staging.
  • Materials. Professional photos and film let you see how the listing looks before it goes on the market.
  • Reports. You get an activity report every month, and I tell you about every buyer's offer straight away, by phone or WhatsApp, also in another time zone.
  • Money. The price can go to your Polish or foreign account, and for larger amounts a notarial deposit is worth considering.

Tax

Income from selling a property located in Poland is taxed in Poland, even if you live abroad. If 5 years have passed since the end of the year of purchase, there is no tax. If not, you file PIT-39 by 30 April of the following year, and the housing relief also covers buying a home abroad in an EU or EEA country. You can work it out in the tax on sale calculator. Settlement in your country of residence depends on the double taxation treaty, so it is worth asking a local adviser.
